On Thursday, Denver District DA’s office dropped the second-degree murder charge against a former security guard for a Denver television news station.

It was in October 2020 when the far-left ‘private security guard’ for 9News fatally shot a man in a confrontation after a right-wing rally.

The shooter, Matthew Dolloff, 32, killed 49-year-old Lee Keltner after a skirmish that saw Keltner spray him in the face with mace, with the entire incident caught on video.

Douglas Richards, Dolloff’s attorney said that the Denver District Attorney’s Office informed him by phone Thursday that prosecutors would dismiss the charge at a pre-trial hearing on March 21. Dolloff did not face any other charges in the case.

“They just said they don’t believe they can prove the case beyond a reasonable doubt based upon the evidence,” said Richards, who declined further comment.

Carolyn Tyler, a spokeswoman for the district attorney’s office, said prosecutors had informed the family of the 49-year-old victim, Lee Keltner, that the case would be dismissed.

“In line with our ethical obligations, we cannot overcome the legal justifications of self-defense or defense of others,” she said in an emailed statement.

On Thursday, prosecutors confirmed to CBS4 they were dropping charges against Dolloff.

“I can confirm that having fully considered the facts and circumstances surrounding the charges, today we informed Lee Keltner’s family members that we will soon dismiss the criminal case against Matthew Dolloff. In line with our ethical obligations, we cannot overcome the legal justifications of self-defense or defense of others. We are not able to prove guilt beyond a reasonable doubt,” stated Carolyn Tyler, Communications Director for the Denver District Attorney’s Office.

In the pictures shown below, it can be seen in the first picture that they approach each other. Then Dolloff pushes Keltner and Keltner retreats. In response, the grandfather Keltner shoots what was reportedly bear spray at Dolloff.
