On Wednesday, U.S. Rep. Mo Brooks’ (R-Ala.) case has formally dismissed by a federal judge. The lawsuit alleged the congressman incited violence with his speech at a rally before the January 6 Capitol protest.
U.S. District Judge Mehta Amit ordered the dismissal of the lawsuit against Brooks is after almost three weeks the judge said he would drop Brooks from the lawsuit pending Brooks’ filing of a motion to dismiss.
California Rep. Eric Swalwell filed the lawsuit last year to hold the defendants partially accountable for the January 6 Capitol. This is after Brook provided a speech. This is the evil we are up against.
In a ruling last month U.S. District Judge Amit Mehta said the claims against Brooks, Rudy Giuliani, and Donald Trump Jr. were due to be dismissed. The court allowed claims against former President Trump to go forward.
According to the AL.com report:
The final step has been taken in removing U.S. Rep. Mo Brooks from a federal lawsuit alleging he played a role in the siege of the U.S. Capitol 14 months ago by pro-Trump supporters.
The judge in the case, U.S. District Judge Mehta Amit, entered his order Wednesday dismissing all claims against Brooks. The dismissal comes almost three weeks after the judge said he would drop Brooks from the lawsuit pending Brooks’ filing of a motion to dismiss.
The ruling also comes less than 24 hours after the suit’s plaintiff, U.S. Rep. Eric Swalwell, D-Calif., filed a memo objecting to Brooks being dropped from the case.
Brooks had been a co-defendant with former President Donald Trump, Donald Trump Jr. and Trump attorney Rudy Giuliani. All defendants except the former president have been dismissed from the case.
